Meta’s New Commercial Terms: What Businesses Need to Know (November 2026)

Gradezilla card: Meta's new commercial terms are on hold, what businesses need to know

Meta’s new commercial terms, the updated Commercial Terms and Self-Serve Ad Terms that businesses using Facebook, Instagram, WhatsApp or Threads (Nieman Lab) would be bound by once they take effect, are on hold. Meta first set them for 30 October 2026, moved them to 20 November, then said on 28 October it will consult industry groups first. Until then, your current terms still apply.

Key takeaways

  • What changed: as reported by PPC Land, the draft terms let Meta’s automated tools crawl and collect content from websites associated with a business’s use of Meta’s products, and make businesses solely responsible for AI edits to their ads.
  • Status: Meta’s VP of communications Andy Stone said Meta will not make the policy changes “without a full consultation with industry groups and leaders”, and existing terms stay in place until then (Nieman Lab).
  • Regulators: the UK Competition and Markets Authority opened a Competition Act investigation on 30 October, and the Oslo District Court temporarily barred Meta from implementing the terms after ten Norwegian media companies sued (CMA; PPC Land).
  • What to do: nothing is forced on you today, but audit your AI ad settings, review what your landing pages expose, and read the final text before you keep advertising once Meta sets a new date.

What are Meta’s commercial terms?

Meta’s commercial terms are the contract between Meta and any business that uses its business products and tools, including Pages and ads. There are two documents in play. The Commercial Terms cover business use of Meta’s products in general, and the Self-Serve Ad Terms cover advertising you buy yourself in Ads Manager. According to PPC Land, Meta revised both at the same time.

Most small businesses never read these terms. That is why this update matters: according to PPC Land’s reading of the preview, continuing to use Meta’s business products after notice counts as acceptance, and there is no way to accept part of the terms and reject the rest. If you run ads for your shop in Beirut or Riyadh, or manage a client’s Page, the new terms would apply to you just as much as to a large publisher.

What would the new Meta commercial terms change?

Meta has published a preview of the updated terms, but the coverage below is based on how trade and news outlets have read it. Here are the main points as reported:

AreaWhat has been reportedSource
Website crawlingSection 1 authorises automated tools, including scrapers, bots, spiders and crawlers, to access, index, cache, analyse and collect content from domains associated with a business’s use of Meta’s products. Meta may also create test credentials to reach covered sites.PPC Land
AI training wordingMeta removed the word “train” from the text. The clause’s stated purpose was rewritten around “advertising and business products”.Nieman Lab, PPC Land
robots.txtMeta says content owners can still use robots.txt to signal preferences, but no version of the terms includes that language.Nieman Lab
AI edits to adsA new AI Features section says Meta’s AI features “may make mistakes” and makes the business solely responsible for the risks.PPC Land
AcceptanceContinued use after notice counts as acceptance, with no partial opt-out from the crawling paragraph.PPC Land
US arbitrationUS businesses have 30 days from first acceptance to opt out of arbitration.PPC Land

Meta’s position is different. According to Social Media Today, Meta maintains the update is not about scraping and that the data gathering is “for the sole purpose of ad targeting”. Meta also rejects the complaint, from publishers and advertisers, that the contract gives it unlimited rights to use their content for AI, PPC Land reports.

In our view, the clause that matters most to everyday advertisers is not crawling but AI edits. PPC Land reports agencies saying Meta’s AI has added sitelinks, translated copy and generated images to ads, sometimes without the advertiser switching those features on. Meta says individual features can be turned off, but has not said directly whether advertisers are liable for features they never enabled. If the business carries sole responsibility for those edits, reviewing your Advantage+ creative settings stops being optional. Our guide to Meta Advantage+ Creative explains where those settings live.

Why did Meta delay the new terms?

Pressure came from publishers, courts, politicians and regulators within about two weeks. Here is the timeline, based on the sources at the end of this article:

Date (2026)What happened
15 OctoberNieman Lab first reports on the terms.
Mid to late OctoberEuropean press associations write to the European Commission citing possible Digital Markets Act breaches, two German publisher associations ask it to block the terms, and UK politicians and German publishers urge regulators to pause them (Nieman Lab). The European Publishers Council also calls for the terms to be suspended (PPC Land).
By 23 OctoberAfter talks with the CMA, Meta moves the start date from 30 October to 20 November.
27 OctoberThe Norwegian Media Businesses’ Association (MBL) files for an injunction on behalf of ten media companies, including NRK, TV 2 and Schibsted (PPC Land).
28 OctoberThe Oslo District Court temporarily bars Meta from implementing the changes while their legality is assessed. The same day, Andy Stone says Meta will consult industry groups first.
30 OctoberThe UK CMA opens a formal investigation under the Competition Act 1998.
2 NovemberSocial Media Today notes that the top of Meta’s terms preview still says the terms take effect on 20 November.

Two US senators, Adam Schiff and Marsha Blackburn, also wrote to Mark Zuckerberg asking Meta to withdraw the terms as written, Nieman Lab reports. Meta has not said which groups it will consult or when the consultation will end.

What is the UK CMA investigating?

The CMA is examining whether Meta’s terms breach the Chapter II prohibition on abuse of a dominant position. It says the terms could let Meta collect content from publishers’ and businesses’ websites and use it for its own products, including AI features, without giving those businesses a choice. The CMA must first decide whether Meta holds a dominant position in a relevant UK market. It stresses that no decision has been made on whether Meta has broken the law.

CMA chief executive Sarah Cardell said that “where a company holds a dominant position, it must not use that position to impose unfair terms.” Meta told The Next Web there were “no grounds” for an investigation. Separately, the CMA is asking Meta for information about Meta One, its business subscription service, which we explain in Meta One plans explained.

Do Meta’s new terms apply in Lebanon, Saudi Arabia and the Gulf?

The regulatory action so far is in Europe and the UK, but the terms themselves are written for every business that uses Meta’s business products. According to PPC Land, that includes websites associated with business accounts, such as advertisers’ landing pages and shops. The Oslo order comes from a Norwegian court, and PPC Land notes it is unclear whether it covers only the ten applicants, all Norwegian businesses or more.

In our view, a business in Lebanon, Saudi Arabia or the UAE should assume the final version will apply to it once Meta sets a new date. For now, nothing has changed: the existing terms remain in force until the consultation ends.

What should advertisers and business owners do now?

You do not need to stop advertising. But this is a good moment to tidy up, so you can decide calmly when the final terms arrive. Our checklist:

  1. Audit your AI ad settings. Open each active campaign and check which Advantage+ creative enhancements are on. Turn off anything you have not reviewed, and preview your ads in every placement.
  2. Review what your landing pages expose. If you link ads to a website or shop, check what is publicly visible there, such as price lists, customer content or downloadable files, and decide whether you are comfortable with it being crawled.
  3. Check your robots.txt. Meta says robots.txt can still signal your preferences, even though the terms do not promise to respect it. Ask your web developer what your file currently allows.
  4. Watch for Meta’s notice. Under the reported acceptance clause, keeping on using Meta’s business products after notice counts as acceptance. When a new date is announced, read the final text, not just the coverage.
  5. Get advice if you are regulated or a publisher. Clinics, banks, media outlets and agencies that run ads for clients are likely to carry more risk from the crawling and liability clauses. This article is not legal advice.
  6. Document your decisions. Keep a note of the settings you changed and when. If an AI edit causes a problem later, you will want a record.

If you manage several assets, Meta Business Suite is the easiest place to see which Pages, accounts and ad accounts sit under your business. And to see which images and videos are actually performing before you change anything, use the Meta Ads creative breakdown.

What does this mean for AI in advertising?

In our view, this dispute is less about one contract and more about who carries the risk as ad platforms automate more of the work. Meta is building tools that write, edit and target ads for you, such as the Meta AI Business Assistant. The terms debate shows that businesses, regulators and publishers want a say in two questions: what data those systems can collect, and who is responsible when they get something wrong. Marketers who understand both the tools and the fine print will be better placed than those who only press “publish”.

FAQ

What are Meta’s new commercial terms?

They are revised versions of Meta’s Commercial Terms and Self-Serve Ad Terms, the contracts every business accepts when it uses Meta’s business products and ads. As reported by PPC Land, the drafts allow automated crawling of websites associated with a business and make the business solely responsible for AI edits to its ads.

When do Meta’s new commercial terms take effect?

There is no confirmed date. Meta moved the start from 30 October to 20 November 2026, then said on 28 October it will not make the changes without a full consultation with industry groups. Meta’s preview page still showed 20 November as of 2 November, according to Social Media Today.

Will Meta scrape my website?

The draft terms, as reported, authorise Meta’s automated tools to collect content from domains associated with a business’s use of Meta’s products. Meta says the data gathering is for ad targeting and that site owners can still use robots.txt to signal preferences. The current terms remain in place until the consultation ends.

Can I opt out of Meta’s new commercial terms?

Not partially. According to PPC Land, continuing to use Meta’s business products after notice counts as acceptance, and there is no partial opt-out from the crawling clause. US businesses would have 30 days from first acceptance to opt out of arbitration.

Why is the UK CMA investigating Meta?

The CMA opened an investigation on 30 October 2026 under the Competition Act 1998 to examine whether Meta is abusing a dominant position by imposing unfair terms on businesses. It has not decided whether Meta broke the law, and Meta says there are no grounds for the investigation.

Do the new terms affect advertisers in Lebanon and Saudi Arabia?

The terms are written for all businesses using Meta’s business products, so in our view advertisers in Lebanon and the Gulf should expect the final version to apply to them. For now nothing has changed, because Meta’s existing terms stay in force until the consultation ends.

What should I do before the terms take effect?

Review which Advantage+ creative enhancements are switched on, check what your landing pages and robots.txt expose, and read the final text when Meta announces a date. Regulated businesses and publishers should get legal advice.
